How To Start An LLC – Step By Step

Now let’s talk about the steps that you need to take to form your LLC.   This is going to be a general outline of the steps that one should take in order to start an LLC.  It should be noted that each State has different requirements and different forms to fill out. I won’t be going into the differences State by State in this post but we do have that information here on our site.

Now some will tell you you first need to decide which State to register your LLC in.  We recommend you form your LLC in the State in which you reside and do business as this is generally best. 

Step 1 in forming your LLC would be deciding on the name of your business.  You’ll want to make sure that there is not another business with a name exactly like, or very close, to the name that you choose for your business. Most States have a name check tool on the Secretary of State’s website that will help you with this. 

Step 2 is deciding upon a physical address to use for your LLC.

Step 3 will be deciding who will be your registered agent.  It can be one of the LLC members, or you can pay for a registered agent service if privacy is a concern – this is something we can help you with.   The registered agent for an LLC is just someone with a physical address in the State who can accept legal documents, tax notices, and subpoenas on behalf of the LLC.

Step 4 is actually obtaining and correctly filling out the proper paperwork with your State. 

Step 5 is getting your EIN number.  Think of your EIN as similar to a social security number but for your LLC. This number will be required to get a checking account for your business.

Step 6 would be setting up your business checking account. 

That’s it – you’re ready for business to commence!
